TikTok files lawsuit against U.S. Government, claims proposed ban violates First Amendment

TikTok filed a lawsuit against the federal government on Tuesday to block the enforcement of a new law signed last month that would ban the distribution of popular video-sharing apps in the United States unless their Chinese parent company, ByteDance, divests them.

In their filing with the United States Court of Appeals for the District of Columbia Circuit, TikTok and ByteDance argue that the ban infringes upon the First Amendment rights of its 170 million U.S. users.

The complaint states, “For the first time in history, Congress has enacted a law that subjects a single, named speech platform to a permanent, nationwide ban and bars every American from participating in a unique online community with more than 1 billion people worldwide.” TikTok asserts that the prohibition is “unconstitutional.”
