A California judge allowed the trial of Snap’s lawsuit, which was brought by parents of kids who overdosed on drugs they believed they had purchased through the app, on Tuesday.
According to the lawsuit, some of Snapchat’s distinctive features—like its ability to locate locations, the ability to delete messages automatically, and its “My Eyes Only” privacy feature—make it harder to keep an eye on illegal behavior and are especially alluring to drug dealers.
“Snap and Snapchat’s role in illicit drug sales to teens was the foreseeable result of the designs, structures, and policies Snap chose to implement to increase its revenues,” the April 2023 complaint claimed.

Because of Snap’s disappearing message feature, family members of over sixty young people who overdosed on fentanyl launched a lawsuit against the messaging app in October 2022. An amended version of the complaint issued in April 2023 states that “Snap and Snapchat’s role in illicit drug sales to teens was the foreseeable result of the designs, structures, and policies Snap chose to implement to increase its revenues.”
In each of the incidents save two, a child died after taking the allegedly obtained drugs over Snapchat. Snapchat attempted to have the case dismissed, but the judge rejected the company’s arguments over 12 of the 16 claims made in the lawsuit.
